Data protection
Data protection
I. General
(1) Below, we will inform you about the collection of personal data when using our website.
(2) With reference to the definition of Article 4 No. 1 of Regulation (EU) 2016/679 (hereinafter referred to as “General Data Protection Regulation” or “GDPR” for short), the term “personal data” means all data that can be personally related to you. This includes, for example, name, address, email address, user behavior. With regard to further terms, in particular the terms “processing”, “responsible person”, “processor” and “consent”, we refer to the legal data protection definitions of Article 4 GDPR.
(3) For matters that have an effect in Switzerland, even if they are initiated outside Switzerland, the Swiss Federal Act on Data Protection, hereinafter referred to as “DSG”, also applies. However, we always use the terms of the GDPR here. The terms of the GDPR “personal data”, “processing”, “contract processor”, “special categories of data” and data portability also mean the terms “personal data”, “processing”, “order processor”, “data transfer” and “particularly sensitive personal data” used in the DSG. In this case, the legal meaning of the terms is determined by the DSG.
(4) In principle, we only process personal data insofar as this is necessary to provide a functional website and the content and services we offer. Personal data will only be processed regularly if you have given us consent within the meaning of Art. 6 para. 1 lit. a) GDPR or the processing is permitted by statutory provisions, in particular through one of the legal bases set out in Art. 6 para. 1 lit. b) to lit. f) GDPR.
(5) Your personal data will be deleted or blocked as soon as the purpose of storage expires. Storage can also take place if this is provided for by national or European regulations to which we are subject. In this case, the data will be blocked or deleted when the storage period prescribed in the respective regulations has expired. The latter does not apply if further storage of the data is necessary to conclude or fulfill a contract.
(6) Insofar as we use contracted service providers for individual functions of our website or would like to use your data for advertising purposes, we will inform you in detail about the respective processes below.
II. Responsible body
(1) Responsible person within the meaning of Article 4 No. 7 GDPR, which is other data protection laws applicable in the member states of the European Union and other regulations as well as provisions relating to data protection law:
LivEye GmbH
Managing Director: Carsten Simons
Europa-Allee 56b 54343 Föhren

IV. Your rights
(1) You have the following rights vis-à-vis us with regard to personal data concerning you:
- the right to information,
- the right to correction and deletion,
- the right to restrict processing,
- the right to object to processing, - the right to data portability.
(2) You also have the right to complain to a data protection supervisory authority about the processing of your personal data by us.
(3) Within the scope of the DSG, you also have the right to:
- Data release, - data destruction
V. Processing of personal data when using our website for informational purposes
(1) If you visit our website without registering or otherwise providing us with information ('informational use'), we only collect the personal data that your web browser transmits to our server. If you would like to view our website, we collect the following data, which is technically necessary for us to enable you to view our website and to ensure stability and security: IP address, date and time of the request, time zone difference to GMT, content of the website, access status (HTTP status), amount of data transferred, request website, web browser, operating system, language and version of the browser.
(2) The above data is also stored in so-called log files on our servers. This data is not stored together with other personal data about you.
(3) The storage of the above data in log files serves to ensure the functionality and optimization of our website as well as to ensure the security of our information technology systems.
(4) There is no evaluation of this data for marketing purposes. Our legitimate interest in data processing lies in the above purposes. The legal basis for the collection and temporary storage of the above data and log files is Art. 6 (1) (f) GDPR. The above data for providing our website is deleted when the respective session is over. The collection of the above data to provide our website is absolutely necessary for the operation of our website.
VI. Objection and removal option
Insofar as data processing is based on your consent or our legitimate interest, you have the right to object to processing or withdraw your consent at any time. Your objection or revocation only has effect for the future. If cookies are used for which there are technical options for deactivating them, this is set out in each case above. You can contact datenschutz@liveye.de at any time to exercise your right of objection or withdrawal. If you object to processing based on our legitimate interest, we may still continue processing, except in the case of direct marketing, if we can demonstrate compelling legitimate grounds for processing that outweigh your interests, rights and freedoms.
VII. Recipients of data and data transfers
Some of your personal data on the website is also processed by contract processors, in particular the hosting of the website and the use of analysis tools. These are included exclusively on the basis of an agreement to an order agreement in accordance with Article 28 (3) GDPR. Any data transfers to third countries such as the USA are carried out on the basis of standard contractual clauses or the EU-U.S. Data Privacy Framework.
VIII. Contact
(1) If you contact us by email, the personal data you provide us with your email will be stored.
(2) We also have a contact form on our website, which you can use to contact us. The data you enter in the input form will be sent to us and stored: first name, last name, email address, telephone number, company name, your message.
(3) The data is used exclusively to answer your questions. Unless explicitly stated in this privacy policy, the data will not be passed on to third parties. In addition, we record your IP address and the time of sending.
(4) The processing of the above personal data is for the sole purpose of processing your inquiries.
(5) The processing of further personal data resulting from the use of the contact form provided on our website serves to prevent misuse and to ensure the security of our information technology systems.
(6) This is also our legitimate interest in processing your personal data. If you have given us consent to this, the legal basis for processing this data is Art. 6 para. 1 lit. a) GDPR. Otherwise, the legal basis for processing this data is Art. 6 para. 1 lit. f) GDPR. Insofar as you wish to effect the conclusion of a contract by contacting us, Art. 6 para. 1 lit. b) GDPR provides an additional legal basis.
(7) Subject to legal retention periods, the data will be deleted as soon as we have finally processed your request. If you contact us by email, you can object to the storage of your personal data at any time. We would like to point out that in this case, your request cannot be processed further. You can declare your withdrawal or objection by sending an e-mail to our e-mail address given in the legal notice.
IX. Newsletters and promotional emails
If you give us your consent, we may contact you by email for advertising purposes. To ensure that newsletters are sent by consent, we use the so-called double opt-in procedure. As a result, the potential recipient can be added to a mailing list. The user is then given the opportunity to confirm the registration in a legally secure manner by means of a confirmation email. The address is only actively added to the mailing list when confirmation is received. The data is processed exclusively to send the requested information and offers.
Even without express registration, we may use your email address to inform you about similar offers and products or new features in our online shop based on your previous orders.
To send mailings, we use service providers who we have integrated as contract processors in accordance with Article 28 GDPR.
You can opt out of receiving the newsletter or other product information at any time with effect for the future, for example via the “unsubscribe” link in the newsletter. We will also inform you of the option to unsubscribe in the individual emails.
The legal basis for processing is your consent to receive the newsletter, otherwise our legitimate interest in maintaining existing customer contacts.
X. Registration for the planning tool and shop
You can save your plans in the planning tool at app.nestorsecurity.com. To do this, you must first register a user account. To do this, we need the following information: company, first and last name, e-mail address and a password. To log in later, all you have to do is enter your email address and password. If you book or buy a service from us via your user account, you must provide various other data that is required to fulfill the concluded contract. The legal basis for processing this data is the necessity to fulfill the user relationship or any contractual relationship that may have been entered into. The storage period is therefore generally based on the duration of the contractual relationship. However, after their end, alternative legal bases may intervene, such as statutory storage periods.
XI. Payment processing
Our payment transactions are processed via Shopify. Your payment details are collected by us and sent to Shopify for further processing. This is also done exclusively for payment processing and, accordingly, also on the legal basis of contract fulfilment. Shopify's processing of your data is subject to their privacy policy, available at https://www.shopify.com/de/legal/datenschutz
XII. Cloudflare
We use the service on our website.
Technically, data traffic between your device's browser and our website is routed via the provider's network. The provider can cache, log and analyze data traffic, for example to identify and ward off attacks on our website. According to the provider, the nearest data center is regularly used for this purpose, but possibly also data centers outside the European Union, e.g. in the USA. The cached data is generally deleted within a few hours, but no later than after three days. In addition, with your consent, the service may store cookies on your computer for optimization and analysis.
We use the service to optimize the presentation of the web pages on our website, in particular to increase the loading speed of the page content. This allows us to improve our offer and user experience for you. The use of the service also serves the purpose of ensuring the error-free functionality of our website and protecting our website from attacks such as DDoS attacks.
The service transfers personal data to the USA. The EU Commission has decided that this country offers an adequate level of data protection (TADPF). The service has submitted to TADPF.
The legal basis is Art. 6 (1) (f) GDPR.

XIII. Processing of personal data through cookies
(1) We use so-called cookies on our website. Cookies are small text files that are stored on the storage medium of your terminal device, such as on a hard disk, and through which certain information flows to us as the location that sets the cookie. Cookies cannot run programs or transmit viruses to your device. This website uses the following types of cookies, the scope and functionality of which are explained below.
(2) Cookies that are stored associated with your web browser:
Persistent cookies: These cookies are automatically deleted after a specified period of time, which may vary depending on the cookie. You can delete these cookies at any time in your web browser settings.
(3) The processing of personal data through the above cookies serves to make the overall offering of our website more user-friendly and effective for you. Some functions of our website cannot be offered without the use of these cookies. In particular, some features of our website require that your web browser can be identified even after a page change. If you have an account, we use cookies to be able to identify you for subsequent visits. This prevents you from having to log in again every time you visit our website. The data processed by cookies that is necessary to provide the functions of our website is not used to create user profiles. Insofar as cookies are used for analysis purposes, they are used to improve the quality and usability of our website, its content and functions. They enable us to understand how the website, which functions and how often they are used. This enables us to continuously optimize our offering.
(4) Insofar as cookies are not technically necessary, we only use them with your previously stated consent, which you can also withdraw at any time. The legal basis is § 25 para. 1 TTDSG in conjunction with Art. 6 para. 1 lit. a) GDPR.
(5) The above cookies are stored on your terminal device and transmitted from it to our server. You can therefore configure the processing of data and information using cookies yourself. You can make appropriate configurations in your web browser settings, which, for example, allow you to reject third-party cookies or cookies altogether. In this context, we would like to point out that you may then not be able to use all functions of our website properly. We also recommend regularly deleting cookies and your browsing history manually.
1. Technical cookies
Technically necessary cookies are used to provide you with additional functionalities or a more convenient use of the website, for example by saving your country or language settings. Technical cookies are also usually automatically deleted when you close your browser (session cookies), but in other cases only after a longer period of time (persistent cookies). The storage period can be viewed in your browser. The legal basis is Section 25 (1) TTDSG in conjunction with Art. 6 (1) (a) GDPR.
Google Maps
We use the service on our website.
This allows us to display interactive maps directly on the website and allows you to conveniently use the map function. By visiting our website, the provider receives the information that you have accessed the corresponding subpage of our website. Your IP address will be transmitted in the process. This is done regardless of whether the provider provides a user account through which you are logged in, or whether there is no user account. If you are logged in to the provider, your data is directly assigned to your account. If you do not want it to be associated with your profile with the provider, you must log out in advance. The provider stores your data as user profiles and uses them for purposes of advertising, market research and/or designing the website in line with requirements. Such an evaluation is carried out in particular (even for users who are not logged in) to provide appropriate advertising and to inform other users about your activities on our website.
We use the service for optimization purposes, in particular to improve the use of our website for you and to make its design more user-friendly.
The service transfers personal data to the USA. The EU Commission has decided that this country offers an adequate level of data protection (TADPF). The service has submitted to TADPF.
The legal basis is Section 25 (1) TTDSG in conjunction with Art. 6 (1) (a) GDPR.

We use the service on our website.
The service allows us as marketers to manage website tags via an interface. The tool that implements the tags is a cookie-free domain and does not collect any personal data itself. The service triggers other tags, which in turn collect data under certain circumstances. The service does not access this data. We use the service on our website.
Among other things, the service uses cookies, i.e. small text files that are stored locally in the cache of your web browser on your device. Using a cookie ID, the provider records which ads are displayed in which web browser. This can prevent ads from being shown multiple times. Using cookie IDs, the service can also record so-called conversions that are related to ad requests. This is the case, for example, if you see a corresponding ad and later use the same web browser to visit the advertiser's website and buy something there. According to the provider, the aforementioned cookies do not contain any personal data. By using the service, your browser automatically creates a direct connection with the provider's server. We have no influence on the scope and further use of the data collected by the provider through the use of the service. To the best of our knowledge, the provider receives the information that you have accessed the corresponding part of our website or clicked on an ad from us. If you have a user account with the provider and are registered, the provider can assign the visit to your user account. Even if you are not registered with the provider or have not logged in, it is possible that the provider will find out and save your IP address.

Google Ads
We use the service on our website.
The service allows us to draw attention to our offers with the help of advertising material on external websites. This allows us to determine how successful individual advertising measures are. These advertising materials are delivered by the provider via so-called “ad servers”. For this purpose, we use so-called ad server cookies, which can be used to measure certain parameters to measure success, such as the display of ads or clicks by users. If you access our website via a corresponding ad, the service stores a cookie on your PC. They are not intended to identify you personally. The following information is usually stored as analysis values for this cookie: unique cookie ID, number of ad impressions per placement (frequency), last impression (relevant for post-view conversions), opt-out information (marking that the user no longer wants to be addressed). These cookies enable the provider to recognize your web browser. If a user visits certain pages of the website and the cookie stored on their computer has not yet expired, the provider and the site operator can recognize that the user has clicked on the ad and was redirected to this page. Each site operator is assigned a different cookie. Cookies can therefore not be traced via the websites of other site operators. We ourselves do not collect or process any personal data in the advertising measures mentioned above. We only receive statistical evaluations from the provider. Based on these evaluations, we can identify which of the advertising measures used are particularly effective.
